This Privacy Policy describes how 4th Move LLC ("4th Move," "we," "us," or "our") collects, uses, and protects information when you use the Saga Split web application and related services (collectively, the "Service"). By accessing or using the Service, you agree to the practices described in this policy.

1. Information We Collect

1.1 Account Information

When you create an account, we may collect:

  • A unique user identifier (generated automatically)
  • Authentication credentials (if you sign in via Google or Apple, we receive only the authentication token and display name provided by those services—we do not receive or store your password)
  • Email address (only if provided voluntarily through a third-party sign-in provider)

1.2 Gameplay Data

As you use the Service, we collect:

  • Story turns, narrative choices, and text inputs you provide during gameplay
  • Character configurations (name, traits, sliders, inventory)
  • In-game economy data (ink balance, purchase history within the app)
  • Session metadata (timestamps, turn counts, device type)

1.3 Purchase Data

If you make in-app purchases (such as ink packs), transaction data is processed by Stripe, Inc. We receive a purchase confirmation and entitlement status. We do not receive, process, or store your full payment card number, billing address, or other financial account details. All payment processing is handled entirely by Stripe.

1.4 Device and Technical Data

We may automatically collect:

  • Device type, operating system, and version
  • App version
  • Anonymous crash reports and performance metrics
  • IP address (collected by our hosting infrastructure for security and abuse prevention; not stored long-term by us)

1.5 Information We Do Not Collect

We do not collect precise geolocation, contacts, photos, microphone input, camera input, advertising identifiers, or any biometric data.

2. How We Use Your Information

We use the information we collect solely for the following purposes:

  • Providing the Service: To operate the game, generate AI-driven narrative content, process your story turns, and maintain your game state.
  • Improving the Service: To analyze gameplay patterns, fix bugs, improve story quality, balance game mechanics, and develop new features. This is the primary reason we retain gameplay data.
  • Processing Purchases: To verify in-app purchase transactions, grant entitlements (ink packs), and maintain purchase records for customer support.
  • Security and Abuse Prevention: To detect and prevent fraud, abuse, unauthorized access, and violations of our Terms of Service.
  • Legal Compliance: To comply with applicable laws, regulations, and legal processes.

We will never sell, rent, lease, or trade your personal information to any third party for any reason, under any circumstances. This is a core principle of 4th Move LLC and will not change.

3. AI-Generated Content

3.1 How AI Is Used

Saga Split uses artificial intelligence (currently provided by Anthropic, PBC via the Claude API) to generate narrative content, dialogue, descriptions, and story elements in response to your inputs. Your story turn text is sent to Anthropic's API for processing and is subject to Anthropic's Privacy Policy and usage policies. We use Anthropic's commercial API, which means your inputs are not used by Anthropic to train their models.

3.2 Content Ownership

You own the content generated during your gameplay sessions. All story text, characters, narratives, and other creative output produced through your interaction with the Service belong to you. You may use, reproduce, modify, distribute, and commercially exploit your generated content for any lawful purpose without restriction and without owing any compensation to 4th Move LLC. We claim no ownership interest in content generated through your use of the Service.

3.3 AI Content Disclaimer

AI-generated content is produced algorithmically and may, without intent, produce text that resembles existing copyrighted works, trademarks, real persons, or other protected material. Such resemblance is coincidental and unintentional. 4th Move LLC does not guarantee that AI-generated content is free from similarity to existing works and expressly disclaims any and all liability for claims arising from such resemblance, including but not limited to claims of copyright infringement, trademark infringement, defamation, or right of publicity violations. You are solely responsible for reviewing any generated content before using it commercially or publicly, and you assume all risk associated with such use. 4th Move LLC provides no warranty, express or implied, regarding the originality or non-infringing nature of AI-generated output.

3.4 License to Improve the Service

While you own your generated content, by using the Service you grant 4th Move LLC a non-exclusive, royalty-free, worldwide license to use anonymized and aggregated gameplay data (which does not personally identify you) to analyze, improve, and enhance the Service, including story generation quality, game balance, and user experience. This license does not permit us to publish, sell, or publicly attribute your specific story content.

4. Third-Party Data Processors

We use the following third-party service providers to operate the Service. These providers process data on our behalf and are contractually obligated to use your data only as necessary to provide their services:

We do not share your personal information with any third party beyond those listed above, and we will never sell your data to advertisers, data brokers, or any other entity.

5. Data Retention

We retain your data as follows:

  • Account data: Retained for as long as your account is active. Upon account deletion, all personally identifiable account data is permanently deleted within 30 days.
  • Gameplay data: Story turns and gameplay records are retained for as long as your account is active and for up to 90 days after account deletion, after which they are permanently purged.
  • Anonymized analytics: Aggregated, de-identified data that cannot be linked back to you may be retained indefinitely for the purpose of improving the Service.
  • Purchase records: Transaction records may be retained for up to 7 years as required by applicable tax and financial regulations.
  • Server logs: Technical logs containing IP addresses and request metadata are automatically purged after 30 days.

6. Data Security

We implement commercially reasonable technical and organizational safeguards to protect your information, including:

  • Encryption in transit (TLS/HTTPS for all communications)
  • Encryption at rest for stored data
  • Access controls limiting data access to authorized systems and personnel
  • Regular security reviews and updates
  • Cloudflare-based DDoS protection and web application firewall

No method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security and are not liable for unauthorized access resulting from circumstances beyond our reasonable control.

7. Children's Privacy (COPPA Compliance)

Saga Split is intended for users aged 13 and older. We do not knowingly collect personal information from children under the age of 13. If you are under 13, you may not use the Service.

If we learn that we have inadvertently collected personal information from a child under 13, we will take immediate steps to delete such information and terminate the associated account. If you are a parent or guardian and believe your child under 13 has provided personal information to us, please contact us at the address listed in Section 13 and we will promptly delete it.

For users between the ages of 13 and 17, we encourage parents and guardians to monitor their use of the Service. We do not condition participation in the Service on the disclosure of more personal information than is reasonably necessary.

8. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) grants you the following rights:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the business purpose for collection, and the categories of third parties with whom it is shared.
  • Right to Delete: You may request the deletion of your personal information. You can initiate this through our account deletion page or by contacting us directly.
  • Right to Correct: You may request correction of inaccurate personal information we hold about you.
  • Right to Opt-Out of Sale or Sharing: We do not sell or share your personal information as those terms are defined under the CCPA/CPRA. We have never sold personal information and have no plans to do so. Therefore, there is no need to opt out, but we honor this right categorically.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.
  • Right to Limit Use of Sensitive Personal Information: We do not collect sensitive personal information as defined by the CPRA (such as Social Security numbers, financial account details, precise geolocation, racial/ethnic origin, or biometric data).

To exercise any of these rights, contact us at the address provided in Section 13. We will verify your identity before processing your request and will respond within 45 days as required by law. You may designate an authorized agent to make a request on your behalf.

Categories of personal information collected in the preceding 12 months: Identifiers (user ID, email if provided via third-party sign-in), internet or electronic network activity (gameplay data, session metadata), and commercial information (purchase history). We do not collect protected classifications, biometric data, geolocation, sensory data, professional information, education information, or inferences drawn for profiling purposes.

9. Your European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and applicable local laws grant you additional rights regarding your personal data.

9.1 Legal Basis for Processing

We process your personal data on the following legal bases:

  • Contract Performance (Art. 6(1)(b)): Processing necessary to provide the Service you have requested, including account management, gameplay, and purchase fulfillment.
  • Legitimate Interests (Art. 6(1)(f)): Processing for service improvement, security, and fraud prevention, where our interests do not override your fundamental rights.
  • Legal Obligation (Art. 6(1)(c)): Processing required to comply with applicable laws (e.g., tax record retention for purchases).
  • Consent (Art. 6(1)(a)): Where required, we obtain your consent before processing. You may withdraw consent at any time.

9.2 Your Rights Under GDPR

You have the right to:

  • Access your personal data and receive a copy of it.
  • Rectification of inaccurate or incomplete data.
  • Erasure ("right to be forgotten") of your personal data, subject to legal retention requirements.
  • Restrict processing of your personal data in certain circumstances.
  • Data portability—receive your data in a structured, commonly used, machine-readable format.
  • Object to processing based on legitimate interests.
  • Withdraw consent at any time where processing is based on consent.
  • Lodge a complaint with your local data protection supervisory authority.

9.3 International Data Transfers

Your data may be transferred to and processed in the United States, where our servers are located. We rely on the following safeguards for international transfers: the EU-U.S. Data Privacy Framework (where applicable), Standard Contractual Clauses approved by the European Commission, and contractual obligations with our sub-processors requiring adequate data protection. By using the Service, you acknowledge this transfer.

10. Do Not Track Signals

Saga Split does not track users across third-party websites and does not serve targeted advertisements. We do not respond to Do Not Track (DNT) browser signals because we do not engage in the type of cross-site tracking that DNT is designed to prevent. Our data collection practices are the same regardless of your DNT setting.

11. Our Commitment: We Never Sell Your Data

4th Move LLC maintains an unwavering commitment to your privacy:

  • We have never sold personal information to any third party.
  • We do not currently sell personal information to any third party.
  • We will never sell personal information to any third party.
  • We do not share personal information with third parties for their own marketing purposes.
  • We do not use advertising networks, behavioral tracking, or retargeting services.
  • We do not monetize your data in any way other than using it to improve the Service itself.

The only reason we collect and retain data is to operate and improve Saga Split. Nothing more.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will:

  • Update the "Last updated" date at the bottom of this page.
  • Provide notice within the app for significant changes.

Your continued use of the Service after the revised Privacy Policy becomes effective constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
